Terms of Service

1. Who we are and acceptance
These Terms are an agreement between you and PriorBeacon ("we", "us"), a Georgia limited liability company. You accept them by purchasing a report, by clicking "Pay" or a similar button at checkout, or by using this website. We may update these Terms prospectively; the version in force at the time of your purchase governs that purchase.
2. What we sell
We sell a one-time digital research report (a "Report") compiled from publicly available United States Patent and Trademark Office (USPTO) records as of the retrieval time stated in the Report. A Report typically identifies a pending, published US patent application in which a USPTO examiner cited a specified patent as prior art, and collects: the application and publication numbers; the applicant or owner of record and its correspondence address as filed; the attorney or agent of record; a verbatim excerpt of the examiner's rejection; related bibliographic data; and links to the USPTO source documents. Reports are delivered electronically (a private web link and an email). There is no subscription, no automatic renewal and nothing to cancel after delivery.
3. What we are not
We are a private company. We are not a law firm and we do not provide legal services or legal advice. We are not affiliated with, endorsed by, or acting for the USPTO or any government agency. A Report does not contain, and must not be read as, an opinion that any person is infringing any patent, that any patent claim is valid or enforceable, that any legal claim exists or has value, or any statement about the products or conduct of any applicant. An examiner's citation of a patent as prior art is a statement about the pending application's claims, not about any product or activity. We make no claim charts, offer no licensing, enforcement or "monetization" services, and do not contact applicants on your behalf.
4. Accuracy
Reports are compiled from government records that may be incomplete, outdated or erroneous, and that we do not independently verify. Office actions may be withdrawn, superseded or responded to at any time. Reports are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
5. Permitted use
You may use a Report for your own personal or internal business purposes, including sharing it with your attorneys. You may not resell or republish a Report as a product; use it to harass anyone; use it for any purpose governed by the Fair Credit Reporting Act (such as eligibility for credit, employment, insurance or housing); or scrape or systematically extract content from this website.
6. Your responsibility; warning about demand letters
You are solely responsible for anything you say or send to third parties on the basis of a Report. Georgia (O.C.G.A. § 10-1-770 et seq.) and more than thirty other states prohibit bad-faith assertions of patent infringement, including by letter or email, and the Federal Trade Commission Act prohibits deceptive practices. Do not accuse anyone of infringement or demand payment without the advice of a registered patent attorney.
7. Price, payment and taxes
The price of a Report is stated in US dollars on the order page (currently $100) and is charged once, at checkout, by card through Stripe, Inc. We do not see or store your card number. Applicable sales tax, if any, is added at checkout.
8. Delivery
Reports are delivered within minutes of a successful payment, by a private link shown on the confirmation page and sent to the email address given at checkout. If a link fails or the email does not arrive, write to support@priorbeacon.com and we will re-deliver.
9. Refunds
You may request a full refund within 14 days of purchase for any reason, one refund per customer, by emailing support@priorbeacon.com. See our Refund Policy, which forms part of these Terms.
10. Intellectual property
The underlying government records are public. The selection, arrangement and presentation of a Report and the content of this website are ours. You receive a non-exclusive licence to use your Report as permitted above.
11. Privacy
Our Privacy Policy explains what personal information we process, including the name and email address used for your transaction and support.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of or relating to a Report or this website, and our total liability for any claim is limited to the amount you paid us for the Report concerned. We are not liable for any action you take toward third parties. Some laws do not allow certain limitations; in those cases the limitation applies to the extent permitted.
13. Indemnity
If you are a business, you agree to indemnify us against claims arising from your use of a Report, including communications you send to third parties.
14. Consumers and businesses
Nothing in these Terms limits rights that consumer-protection law does not allow to be waived. If you purchase on behalf of an entity, you confirm that you are authorised to bind it.
15. Governing law and venue
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction, except that either party may bring an eligible claim in small-claims court.
16. Reviews
Nothing in these Terms restricts your right to review or comment on our products or services, favourably or otherwise.
17. General
If any provision is unenforceable the remainder stays in force. These Terms and the policies they reference are the entire agreement between us about the Reports.
